ORDINANCE NO. 235

           AN ORDINANCE REGULATING AND LICENSING BILLBOARDS; PROVIDING A PENALTY FOR THE VIOLATION THEREOF; AND DECLARING AN EMERGENCY.

           The city of Junction City does ordain as follows:

           Section 1.   Definitions.

           (a)   "Billboards" means any board, fence, sign or structure erected for commercial advertising purposes; but this definition does not include any board or surface used to display official notices issued by any court or public officer in the performance of a public duty, or used to display announcements of meetings to be held upon premises whereon such billboards or bulletin boards are displayed, or used to advertise any business conducted or merchandise sold on the premises; nor does it include a real estate sign advertising for sale or rent the property upon which it stands; nor does it include a bus stop bench containing advertising which has been placed at a location and for a period of time which the council may from time to time permit.

           (b)   "Outdoor advertising" is advertising on any bill-board.

           Section 2.   Permits.   No person, firm or corporation shall construct, alter or move any billboard without first obtaining a permit from the council. The fee for issuing such permit shall be $40.00 per year.

           The permit fee shall be payable on July 1 of each year or on the date the erection of the billboard has been completed, if the erection is after July 1. The permit shall expire on June 30 of each year.

           The application for such permit shall set forth the location of such proposed billboard, and the name and address of the owner of the property upon which the same is to be erected, and shall be accompanied by a sketch of such property and proposed billboard showing the location thereof in reference to the property.

           But no permit shall be granted for any billboard which does not conform to the requirements of this ordinance as to location, construction or otherwise; and when a permit is denied for any such cause, the billboard in question shall immediately be taken down and made to conform to the requirements of this ordinance.

           The construction of all billboards in Junction City shall be in accordance with the standard specification and requirements of billboards now in common usage, and all billboards shall be properly and adequately maintained.

           Section 3.   [Section 3 repealed by Ordinance No. 592, passed June 13, 1972.]

           Section 4.   [Name.]   There shall be placed and maintained at the top of each billboard the name plainly printed of the person, firm or corporation owning or in possession, charge or control of the same for advertising purposes.

           Section 5.   Penalty.   Any person, firm or corporation violating any provision of this ordinance, upon conviction thereof, shall be punished by a fine not exceeding $100.00, or by imprisonment in the city jail not exceeding 20 days, or by both such fine and imprisonment; or the license of any and all of their billboards may be revoked and, upon revocation of any such license, the billboards covered by such license shall be taken down immediately and removed.

           Section 6.   Emergency Clause.   Whereas, there is at the present time no license or regulation of and for billboards in Junction City, an emergency exists, and it is necessary for the preservation of the peace, health, safety and general welfare of the citizens of Junction City that this ordinance take effect immediately; it shall take effect immediately upon its passage by the council and its approval by the mayor.

           Passed by the council and approved by the mayor September 3, 1940.
