AN ORDINANCE ADOPTING CITY OF JUNCTION CITY "PUBLIC WORKS DESIGN STANDARDS" AND "PUBLIC WORKS CONSTRUCTION STANDARDS," AND DECLARING AN EMERGENCY.
WHEREAS the city's specifications went into effect and need significant changes to meet modern construction methods and ADA Standards, and
WHEREAS it is important to have new standards in place for this construction season; now, therefore
THE CITY OF JUNCTION CITY DOES ORDAIN AS FOLLOWS:
Section 1. That a certain set of documents entitled "City of Junction City, Public Works Design Standards" dated February 1998, and "City of Junction City, Public Works Construction Standards" dated April 1998, are hereby adopted as the standard specifications for public works design and construction in the City of Junction City, Oregon. Said design and construction standards are attached and made a part hereof. Copies are available for review at the City Recorder's office and may be purchased for a cost of $35, and $30, respectively. An additional $5 shipping charge per document will apply. [Webmaster's note: these documents are available for sale at City Hall and will not be made available electronically.]
Section 2. Work performed and materials used for public works construction in the City of Junction City, Oregon shall conform to these standards as hereby adopted or amended by Council action.
Section 3. The particulars of said City of Junction City, Public Works Design and Construction Standards, may be amended by city ordinance from time to time upon recommendation of the Public Works Director and approval of the Council.
Section 4. Any person who violates any provision of said specifications or fails to comply therewith; or who builds in violation of any detail of the specifications or plans submitted and approved thereunder; or who builds in violation of any certificate or permit issued thereunder; or who fails to comply with any such order as affirmed or modified by a court of competent jurisdiction; is for each and every violation and non-compliance, respectively guilty of a civil infraction, punishable by fine. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue. All such persons shall be required to correct or remedy such violations of defects within a reasonable time. When not otherwise specified, each period of ten (10) days that a prohibited condition is maintained shall constitute a separate offense. The application of any said penalties shall not negate the enforced removal of the prohibited condition.
Section 5. Emergency Clause. Inasmuch as this ordinance is necessary to the continued peace, health, and welfare of the citizens of Junction City, an emergency is hereby declared to exist, and this ordinance shall be in full force and effect upon its passage by the Council and its approval by the Mayor.
